After SOPA and PIPA, there is yet ANOTHER attempt to destoy the Intenret.
Harvey Weinstein, who is best known for his alternate history flick,
Confederate
States Of America, is now lobbying foir Congress to pass legislation that
would
require ALL web sites to pay a copyright fee just to LINK to copyrigted
content,
REGARDLESS of whether said link is infringing or not.
This could shut down nearly EVERY news site, blog site, and forum on the
Internet.
Even if a site is outside the United States, they could still be subject to
US laws. One
example of a forum that would need to pay copyright fees is one thread at
Figure
Skating Universe, becuase they link of an OC Register article regarding
Caroline
Zhang. If what Weinstein wants were the law now, Figure Skating Universe,
despite
being a British company, would have to pay copyright fees to the new
collection
society that would be created if this new law were ever drafted and enacted.
And what is worse is that what Weinstein intends to push for is a "willing
buyer willing
seller" approach, where a website would have to pay EVERY time someone
clicked
that link. This would create new kinds of logging requirements for websits,
which, by
themselves, would make blog, news, and forum sites, financially prohibitive
to operate.

Forum sites would be liable for any links a user posts, thus ending the
"safe harbor"
this has existed under both the CDA and the DMCA. This is jsut a way to
backdoor
in SOPA. Forums wlll have to review every post their users make, before
allowing
them to appear publicly. This can and should be called SOPA 2.0, becuase it
would
have third-party liability provisions, much like SOPA.
And even foreign sites could be subject to US laws. Precedent was set on
this in the
Richard O'Deweyer case, where a plea bargain was made, in absentia, where
the
former TV Shack operator will pay 20,000 pounds in fines and is sentenced to
time
served, while awaiting extradition, and, in return, will not be extradited
to the United
States.
And it gets even worse. The proposed willing buyer-willing seller regime
will also be
expaneded to YouTube and other video sites as well. Under copyright law now,
YouTube, and sites like it is not liable for any infringing content, unless
they are
notified, and they take it down promptly. Under this new law, they would
have to pay
a licensing fee to this new copyright society for merely LINKING to the
content.
